Lifetime Industry Ban for Former Crypto CEO in New York Settlement

New York State's Attorney General has reached a landmark settlement with Alex Mashinsky, the co-founder and former CEO of the collapsed crypto lending platform Celsius. The agreement imposes severe restrictions and financial penalties.

Key Terms of the Agreement

The settlement centers on two major penalties. First, Mashinsky is permanently banned from participating in any business involving securities, commodities, or digital assets within New York State, effectively ending his career in the industry.

Second, the deal includes a conditional financial settlement that could total up to $35 million. The structure is as follows:

  • Primary Penalty: Mashinsky must forfeit $10 million in ill-gotten gains to the federal government. Failure to do so triggers an additional $25 million payment to New York State.
  • Additional Condition: Mashinsky was separately sentenced to 12 years in prison on federal criminal charges. If he fails to serve his full prison term, he will owe another $10 million.

Case Background and Scope

This enforcement action stems from the collapse of Celsius in the summer of 2022, which froze and led to massive losses of user funds. Investigations alleged that Mashinsky made misleading statements about the platform's safety and stability during its operation.

New York Attorney General Letitia James stated the case sends a clear message that defrauding investors carries serious consequences. The case directly involves over 26,000 investors based in New York, whose losses were central to the investigation.

Legal observers view this settlement as a significant example of state regulators holding crypto executives personally accountable, potentially setting a precedent for future actions.
