New York Regulators Escalate Legal Fight, Sue Kalshi to Enforce Subpoena

The New York State Gaming Commission has taken legal action against event-contract platform Kalshi, filing a lawsuit in the New York State Supreme Court to compel compliance with an investigative subpoena. Court documents revealed on October 23 show regulators are pushing for access to Kalshi's internal operations.

Scope of the Subpoena and Regulatory Aims

Issued on July 31 under the state's racing law, the subpoena demands Kalshi produce documents and data across several sensitive areas. The commission's investigation focuses on:

  • Details of sports event contracts and their execution
  • Whether and how the platform serves users under 21 years old
  • Advertising materials that characterize its products as "betting" or gambling
  • Company ownership structure, governance, and financial relationships

In its filing, the commission stated the investigation aims to determine whether civil penalties should be imposed on Kalshi and related parties, and to calculate appropriate fines. Kalshi has not yet publicly responded to this lawsuit.

A Broader Legal Battle: State vs. Federal Jurisdiction

This lawsuit is the latest move in a comprehensive legal campaign by New York against Kalshi's business model. On the same day the subpoena was issued, July 31, the state's Attorney General and Governor filed a separate suit alleging illegal operations and seeking at least $36 billion in restitution.

Federal courts are also involved. Earlier, on July 7, a federal judge denied Kalshi's request for a preliminary injunction that sought to block state regulatory action.

Split Among Federal Appeals Courts

The Kalshi case highlights a fundamental divide among U.S. jurisdictions over who regulates event-contract platforms. Federal appeals courts are currently split:

The Third Circuit has issued rulings favorable to platforms like Kalshi, while the Ninth and Sixth Circuits have upheld broader state regulatory authority. This judicial split creates uncertainty for future cases and complicates Kalshi's legal path forward.

With the Gaming Commission now taking the matter to state supreme court, the legal battle over the boundaries of this emerging fintech sector is intensifying. The outcome will not only decide Kalshi's fate in New York but could set a significant precedent for regulating similar platforms nationwide.
