Reaffirmation of Sovereign Claims
In a recent diplomatic statement, Iran's top diplomat reiterated the nation's legal stance regarding the Strait of Hormuz, a vital maritime passage linking the Persian Gulf with the Gulf of Oman. He firmly rejected the characterization of these waters as international.
"From the perspective of international maritime law," the Foreign Minister stated, "the Strait of Hormuz falls under the joint sovereignty and jurisdiction of Iran and Oman. All waters within the strait lie inside the territorial sea baselines legally established by the two coastal states."
Geographic and Legal Basis
The Strait of Hormuz is geographically constrained, with its narrowest point measuring only 21 nautical miles (approximately 39 kilometers) wide. Under the United Nations Convention on the Law of the Sea (UNCLOS), a coastal state's sovereignty extends to its territorial sea, up to 12 nautical miles from its baseline. Consequently, straits narrower than 24 nautical miles can be entirely overlapped by the territorial seas of bordering nations.
"The maritime boundaries here are clear and unambiguous," the Minister emphasized. "This grants the littoral states the legal right and responsibility to regulate navigation through these waters. It is situated thousands of miles from the coasts of nations that sometimes claim interests in the area."
The Global Energy Chokepoint
The strategic significance of the Strait of Hormuz cannot be overstated. It serves as a critical artery for global energy supplies, often described as the world's most important oil transit chokepoint.
- Approximately one-third of the world's seaborne crude oil trade passes through this narrow conduit.
- It is the primary gateway for oil exports from major Gulf producers, including Saudi Arabia, Iraq, and the United Arab Emirates.
- Any dispute over transit rights or legal status directly impacts global energy security and geopolitical stability.
Thus, Iran's persistent assertions over sovereignty and regulatory control are not merely legal pronouncements. They represent a calculated move on the complex geopolitical chessboard, with far-reaching implications for international relations and global trade flows.
